Trespass on Land
Trespass on Land is when a person intentional intrudes on the land of another.
The elements of trespass on land are:
- An intentional act
- That causes an intrusion onto land, such as entering the land, causing a thing or a third person to enter the land, remaining on the land, or failing to remove from the land a thing which there is a duty to remove,
- And the land is in the possession of another, irrespective of whether any actual harm or damage is caused to any legally protected interest.
