Products Liability / Strict Tort Liability
Products Liability uses a theory of Strict Tort Liability to hold a manufacturer responsible for injuries caused by defective products, regardless of negligence or privity.
The elements of liability are:
- A product contained a defect;
- The defect in the product caused an injury; and
- – The defect existed when the product left the hands of the manufacturer.
