Publicity Unreasonably Placing Another in a False Light Before the Public often referred to in simply as “False Light”, is when a personal matter, action, or fact is presented to the public in a way that is intentionally deceptive and offensive. False light is similar to, but distinct from, Defamation.
The elements of false light are:
- An implicit false statement of objective fact;
- Actual malice, knowing or reckless disregard for the truth; and
- Injury in the form of mental distress from having been exposed to public view due to the highly offensive nature of the false light.
