Civil Aiding and Abetting
Civil Aiding and Abetting occurs when a party assists or encourages another party to breach a duty owed to a third person.
The elements of civil aiding and abetting are:
- One defendant breached a duty to plaintiff, the result of which injured plaintiff;
- The second defendant knowingly and substantially assisted the first defendant in breaching the duty; and
- The second defendant was aware of its role in promoting the breach of duty at the time it provided assistance.
